Compensation
Once we have established that you have been injured as a result of someone else's negligence, then you are entitled to be compensated for all the losses that you have sustained that are attributable to the accident.
In formulating a claim you have two categories of damage which when added together form the basis of your claim with interest added thereon.
General Damages
Your first head of claim is that of general damages.
This aspect of your claim is intended to compensate you for pain, suffering and loss of amenity, (i.e., the inability to do things that you could have done prior to the accident.) that you have suffered.
The amount of damages awarded under this head is determined by the medical evidence we obtain on your behalf which comprises a medical report prepared by an expert on your injuries after an examination of both you and your medical records. Once the medical evidence is obtained an assessment is carried out with reference to legal journals and the Judicial Studies Board Guidelines which will place your injury within a bracket for an award.

Special Damages
The second head of damages is intended to compensate you for your "out of pocket expenses" and basically comprises of any quantifiable loss which you have sustained as a result of your accident.
This could include:
(i) Road Traffic Accidents
- Insurance excess
- Repair costs and/or write off value
- Diminuton in value on your vehicle following repair
- Travelling expenses
- Medical expenses
- Loss of pension rights
(ii) Employment losses
- Loss of earnings
- Compensation for prejudice on the job market due to injury
- Loss of business profit, increased expenditure to business due to employing somebody to carry out your tasks
(iii) Medical Expenses
- Physiotherapy charges
- Prescription charges
- Medication charges
- Funding for private medical treatment rather than waiting in NHS queues
