NO WIN NO FEE
Many people are intimidated to seek legal advice on their problems as they fear they will expose themselves to costs which they cannot or do not want to incur.
For this reason at Heer Manak Solicitors we offer "free initial consultation" to every one of our personal injury clients. In this way it will cost you nothing to ask us the question "do I have a viable claim?"
Having taken our initial free advice it will then be necessary for you to instruct us formally to pursue the matter on your behalf.
It is a general rule of litigation that if you can prove a claim against another party then that party in addition to paying you compensation will also meet your reasonable legal costs in full which means that you will have to pay nothing.
To protect your interests however, it is necessary for us to ensure that you have adequate protection should your claim fail.
We will therefore investigate whether you have Legal Protection Insurance to cover your costs and those of the Defendant should your action fail. It is common nowadays for people to have the benefit of Legal Protection Insurance without their knowledge. This is usually through membership to a Trade Union, professional body, car or home insurance. When discussing funding we will investigate this on your behalf.
If you do have Legal Protection Insurance your costs will be covered. If you do not have the benefit of Legal Protection Insurance we would probably recommend that your fees be met under a conditional fee agreement which is essentially a "no win no fee agreement" with ourselves. Should we consider that there is a risk of your claim being unsuccessful (which is extremely rare in personal injury claims) then we would also recommend that you purchase an after the event insurance policy, the cost of which would be refundable to you on the conclusion of your claim should it be successful.
Essentially an after the event insurance policy means that for the payment of a small premium (usually between £200.00 to £300.00), the worry is taken out of your claim as even if you lose then the insurers guarantee that they will make payment on your behalf of any disbursements or costs ordered against you by the third party.
Due to changes in the law it is not possible to obtain legal aid to pursue personal injury claims. Notwithstanding this, applications for legal aid are still permitted if the claim is serious in nature or is in the public interest.
At the end of the day as a body regulated by The Law Society, Heer Manak Solicitors are under a duty to advise you of the most effective way to pursue a personal injury claim and to that end we will advise you at the outset of the case the most economic way of pursuing your claim.
